Each undersigned party hereby requests that the Law Offices of Stephen K. Hachey, P.A. (“Hachey”) act as scrivener for each undersigned party in preparing the Lady Bird Deed. Each undersigned party agrees to hold Hachey harmless from any liability, damages or expenses arising out of the preparation of the Lady Bird Deed. Each undersigned party hereby represents and acknowledges that;

  1. The undersigned parties shall review the completed Lady Bird Deed and make all necessary modifications;
  2. Hachey has recommended that the undersigned parties consult with a Certified Public Accountant and the Florida Department of Revenue (“FDR”) regarding IRS and FDR taxes on subject conveyance and
  3. Hachey has recommended that the undersigned parties review their existing title policies and/or mortgage and consult with their title insurer and/or lender, regarding the effect, if any, of the subject conveyance on existing coverage and/or mortgage.

The Grantee(s) listed below direct Hachey to vest title under Lady Bird Deed as a Life Estate to the Grantor(s) and the Remainder to the Grantee(s) and to record the Lady Bird Deed with the Clerk and Recorder of the County in which the subject property is located.

This Deed was prepared at the request of the Grantor with a property description furnished to the preparer and without the benefit of a survey. Also, the Deed was prepared at the request of the Grantor without a title search, exam, or title insurance. The parties, their heirs, successors, or assigns hereby agree to indemnify and hold harmless the preparer for any damages including reasonable attorney fees resulting from an inaccurate or improper legal description, title defect, or encumbrance.
