The key to this type of action is “bona fide, actual, present practical need for the declaration” meaning that the Court will not entertain hypothetical facts, nor will the Court render any type of advisory opinion about a future possibility of legal injury. There must be a present injury for the court to making a ruling on. Declaratory actions are an effective way to resolve real estate disputes and determine the parties’ rights under a deed or real estate contract.
